
Khula
The situation in which the Wife initiates Islamic Divorce proceedings is known as Khul’a. If the
marriage reaches a point of irreconcilable differences based on valid reasons, after all efforts of
reconciliation are exhausted and unsuccessful, then Islam has provided Khula whereby the wife is
permitted to seek a termination of her marriage contract through a Shariah Council and Muslim judge.
In the time of the Prophet (SAWS), the wife of Thabit b. Qais requested the Prophet for a divorce
from her husband. The Prophet asked her to return the garden given to her at the time of marriage as
dower (Mahr). She accepted this condition and the marriage was dissolved.
A) Khula Procedures & Fees
- Full online application form is filled and submitted in full.
B) First Stage- Settlement
- The first payment fee is £250.
- A payment link will be given to you after we processed your application.
- Upon making payment, we shall then arrange a meeting between you and our family counsellor.
During the meeting, you can explain about your situation and why do you want to apply for the Khula
with us. - We shall then send Khula notice via email or post to your husband as we need to hear the
husband’s point of view. - If the Husband responds, we will arrange a meeting with the Husband and seek the best possible
solution for both parties (reconciliation or divorce). - If the Husband refused to respond to all our notices OR refused to agree to the Khula, then your
case will be moved to the Second Stage. - The timeline for the First Stage is 3 months – 4 months.
C) Second Stage-Judgment
- Additional £150 will be charged if the parties failed to reach divorce settlement or if Respondent (the Husband) is not reachable or not cooperating with us during the First Stage.
- We will notify you when we have reached this stage.
- You will have a meeting with a Shariah Council Panel.
- The Shariah Council Panel will do few attempts to reach the Husband.
- A Shariah Council Meeting will be held for all the panels to present the cases and for the Council to make the decision for your case.
- The timeline for the Second Stage is 3 months- 4 months.
D) Documents Required
- Form of ID for the Wife
- Form of ID for the Husband
- Your Nikah Certificate (Islamic Marriage and/or Civil Marriage)
- Your Decree Nisi or Decree Absolute (if Applicable)
- Letter from the solicitor or court (if Applicable)
- A Statement of Dissolution
- Any supporting documents to strengthen your case (Medical Report, Police Report, Photos) (if Applicable)
*Please take note if your Husband is not in the United Kingdom, kindly ensure that you have your Husband’s email address or any modes of communication that will enable us to contact your Husband.
*Please take note that any marriage which take place abroad, recognised by the relevant law of the land, are recognised by the English Law as a legal marriage.
*If you were married outside United Kingdom and would like to register your Khula in your home country, kindly take note that you need to bring the Khula Certificate to your home Embassy or the Home Office to get it registered/endorsed before bringing the Khula Certificate to your home country.

A: Yes, however we may need to have a copy of your Nikah Certificate.

A: Yes, however we need you to get two witness to sign Witness Statements.
Q: How long is the whole Khula Process?
A: 4 months to 1 year.
Q: Is my Khula valid under the UK law?
A: Our Khula is an Islamic divorce which means it is only accepted between Mosques in the UK. To have your divorce legally valid and recognized under the UK Law, we strongly advice you to apply for the Civil Divorce.
Q: My husband is missing/ I do not know where my husband is/ I do not have my husband’s contact details. What should I do?
A: It is important that we have your husband’s contact details (email, phone number or postal address). If you do not have any, we appreciate if you can provide your husband family’s contact details. Without this, it may prolong your case.
